What is ITAR?

The International Traffic in Arms Regulations (ITAR) is a set of U.S. government regulations that control the export and import of defense-related articles and services as defined in the United States Munitions List (USML). Administered by the Department of State’s Directorate of Defense Trade Controls (DDTC), ITAR is designed to prevent sensitive military technology from being accessed by foreign adversaries or unauthorized individuals. These regulations apply to various defense-related items, including firearms, missiles, satellites, and night vision technology.

Night vision devices fall under ITAR due to their potential military applications. Advanced night vision optics, such as Gen III image intensifier tubes and thermal imaging equipment, provide a significant tactical advantage in low-light and combat environments, making their sale and distribution highly regulated by the U.S. government. Why Does Nightfall Optics Require ITAR Compliance Agreements?

As a supplier of high-quality night vision and thermal imaging devices, Nightfall Optics is legally bound to comply with ITAR regulations when selling their products. When a customer purchases night vision equipment from Nightfall Optics within the United States, they are required to sign an ITAR compliance agreement. This agreement serves multiple purposes:

  1. Acknowledgement of ITAR Regulations – The buyer confirms that they understand that night vision devices are restricted by U.S. law and cannot be exported, sold, or transferred to non-U.S. citizens or foreign governments without proper authorization.
  2. Prevention of Unauthorized Export – ITAR strictly prohibits the sale, shipment, or transfer of restricted night vision equipment to foreign nationals, organizations, or countries without a government-issued export license. This agreement ensures the buyer is aware of these legal restrictions.
  3. Legal Protection for Nightfall Optics – By requiring customers to sign an ITAR compliance agreement, Nightfall Optics protects itself from potential legal consequences if a buyer unlawfully transfers or exports a restricted product. Violations of ITAR can lead to severe penalties, including fines of up to $1,000,000 per violation and criminal charges resulting in imprisonment.
  4. Safeguarding National Security – The U.S. government enforces ITAR to prevent adversarial countries and unauthorized groups from acquiring military-grade night vision optics. Who Can Purchase ITAR-Restricted Night Vision?

ITAR regulations state that only U.S. citizens or lawful permanent residents can purchase and possess certain night vision products. Additionally, buyers cannot transfer, loan, or resell these products to non-U.S. persons without explicit approval from the Department of State.

Some of the key restrictions include:

  • ITAR-restricted night vision devices cannot be taken outside the U.S. without an approved export license.
  • Foreign citizens, including legal residents on visas or work permitscannot purchase or possess ITAR-controlled night vision optics.
  • Violating ITAR regulations can result in criminal prosecution, heavy fines, and the seizure of night vision equipment.

Purchasing Agreement

U.S. Export Controls and Trade Sanctions Laws and Regulations – Customer Agreement

 

I.

Customer acknowledges and understands that any product, software, or technology — including technical data, specifications, or product schematics (collectively, “Products”) — obtained from the Company are subject to U.S. export control and economic sanctions laws and regulations (collectively, “U.S. Export Control Laws”).
These include, without limitation:

  • the Export Administration Regulations (15 CFR Parts 730-774) administered by the U.S. Department of Commerce’s Bureau of Industry and Security (“BIS”),

  • the International Traffic in Arms Regulations (22 CFR Parts 120-130) administered by the U.S. Department of State’s Directorate of Defense Trade Controls (“DDTC”), and

  • the sanctions regulations (31 CFR Parts 500-599) administered by the U.S. Department of the Treasury’s Office of Foreign Assets Control (“OFAC”).

II.

Customer represents that it is in compliance in all material respects with all applicable U.S. Export Control Laws and will continue to comply fully with them regarding any Products obtained from the Company.

III.

The Company has sold the Products with the understanding that they will be used in, and remain within, the United States.

IV.

Customer understands that the Products are subject to strict U.S. licensing requirements and that it is unlawful to export, re-export, transfer, or otherwise dispose of the Products without first obtaining the required authorization from the relevant U.S. government agency.

V.

Customer acknowledges that it assumes all responsibility, risk, and liability for obtaining any necessary licenses or other required approvals from the appropriate U.S. government agency(ies) if the Customer exports, re-exports, transfers, or takes any other action with respect to the Products that may require a license or authorization under the U.S. Export Control Laws.

VI.

Any failure to comply with U.S. Export Control Laws or other applicable U.S. law may result in financial and other penalties against Customer by the U.S. government.
Customer agrees to indemnify and hold Nightfall Optics harmless from any damages, penalties, or other fines related to this certification or arising from Customer’s breach of any U.S. Export Control Law regarding the Products.

VII.

Without limiting the above, Customer shall not — directly or indirectly — sell, loan, transfer, demonstrate, permit access to, or otherwise engage in any activity concerning the Products to or for any of the following unless all required authorizations have been granted by the applicable U.S. government agency(ies):

  1. Any country or territory subject to a U.S. or United Nations arms embargo (including China and Russia) or a U.S. trade embargo (currently Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk People’s Republic (DNR), and Luhansk People’s Republic (LNR) regions of Ukraine);

  2. Any person or entity listed on any applicable denied, debarred, or sanctioned persons lists, including but not limited to:

    • BIS Denied Persons List,

    • BIS Entity List,

    • DDTC Nonproliferation Sanctions List and Arms Export Control Act Debarred List,

    • OFAC Specially Designated Nationals and Blocked Persons List, and

    • OFAC Foreign Sanctions Evaders List.
      Customers may use the free U.S. government screening tool at CSL Search (trade.gov) to verify that a recipient or entity is not prohibited.

  3. Any military or military-intelligence end-user outside the United States, or if the Product will be incorporated into a “military commodity” controlled by ECCN 0A919, or any end-use prohibited under U.S. Export Control Laws — including, but not limited to, the design, development, manufacture, production, assembly, construction, testing, maintenance, repair, overhaul, use, or stockpiling of:

    • nuclear explosive devices,

    • weapons of mass destruction,

    • missiles, rockets, or unmanned air vehicles,

    • chemical or biological weapons, or

    • nuclear maritime propulsion projects.

VIII.

Customer represents and warrants that it is not listed on any U.S. government restricted or sanctioned persons list, and is not acting on behalf of any such person or entity.

IX.

A breach of this certificate constitutes a material breach of contract. The Company is entitled to pursue any and all remedies permitted by law, including recovery of damages (punitive or otherwise) resulting from such breach.


Customer Certification

By purchasing, possessing, or otherwise accepting delivery of any Product from Nightfall Optics, Customer certifies and acknowledges that:

  1. I am a legal citizen of the United States of America.

  2. I am a lawful permanent resident of the United States (have a valid Green Card).


By proceeding with any purchase from Nightfall Optics, Customer confirms that they have read, understand, and agree to all of the above terms.
